::: About EB5 Program :::
In 1990 the US adopted into law the EB-5 program, which stands for the employment-based fifth category program. The EB-5 program allows foreign investors to invest into U.S. Development projects and so long as that investment creates more than 10 US jobs, the investor obtains the U.S. Green Card. This program allows investors to move themselves with their family to the United States permanently and after certain requirements are met, they can eventually choose to become citizens. This program has been a huge success over the past few decades, especially helping the United States come out of the major financial crisis of 2008 and 2009.
Tens of thousands of people have utilized the EB-5 program over the past few decades to create millions of US jobs and help hundreds of thousands of people immigrate to the United States.
::: EB-5 Program 2022 Changes & Updates :::
On June 30th, 2021, the EB-5 program was shut down as it did not pass a unanimous consent vote in Congress. This lead a complete program shut down and left congress scrambling to reauthorize it as past investor petitions were not being adjudicated. EB5 United had representatives travel to Washington DC in December of 2021 to speak with senators and representatives and vouch for reinstating the program and grandfathering investor petitions so that USCIS is forced to adjudicate all investor petitions, even if there were another program lapse in the future. On March 15, 2022, President Biden signed into law the “EB-5 Reform and Integrity Act”. This included:
1. Program extension to September 30, 2027
2. Grandfathering of all investor petitions submitted prior to September 30, 2026
3. New set-aside visas. This allows investors from backlogged countries, primarily China, Vietnam, and India, to skip any potential line and obtain a visa without delay. 10% of all visas in Urban distressed projects will be set-aside and 20% of visas in rural areas will be set-aside.
4. Rural projects will also receive Priority Processing
