Employment-based immigrants could gain permanent residence years or even decades earlier under legislative provisions retained in a reconciliation bill slated for a House floor vote. In September, the House Judiciary Committee included the immigration measures for the bill on a party line vote. While many lawmakers have focused solely on how to provide relief for those without legal status, Judiciary Committee Chair Jerrod Nadler (Democrats-NY) and Immigration and Citizenship Subcommittee Chair Zoe Lofgren (Democrats-CA) also crafted language, now included in the bill, to help individuals who have applied for legal immigration.

If the measure becomes law, it would be the most significant legislative provision for high-skilled immigrants since Congress passed the Immigration Act of 1990 and increased the annual numerical limit on employment-based green cards to 140,000. The House reconciliation bill would be a significant boon to the competitiveness of the U.S. economy by allowing U.S. employers to attract and retain many of the world’s most highly skilled scientists and engineers.
