E2 visa: Minimum Investment Requirement

A common question that we often get is, “how much do I need to invest to qualify for an investor visa?”

The regulations regarding E-2 (investor) visas are quite ambiguous compared to other types of visas; there is no set minimum amount that you need to invest to get an investor visa. The law vaguely states that you must invest a substantial amount in a U.S. business, but the real question is, what qualifies as a substantial investment?

The amount you would have to invest to obtain an E-2 visa varies based on the business’s value you are planning to invest in. Typically, the lower this value is, the higher your investment must be to qualify for the visa.

We typically advise our clients to be prepared to invest at least $100,000 if they want to obtain an investor visa. While it’s not impossible to get approved with a smaller investment, people who invest a lower amount are more likely to have their application views with more scrutiny. You can get an E-2 visa with investments of less than $100,000, but it is much more of a challenge.

If you are looking to make a smaller investment, then an established company with a proven record of success and a healthy business plan is a better option than smaller franchises and retail stores. Service-based industries can be a better match for investors with limited capital.
