After investing years in their education, foreign students typically look to become permanent residents. After the 2022 EB-5 Reform and Integrity Act (EB-5 RIA) the EB-5 greencard became the fastest and most secure path to protecting a future in the United States after graduation. The F-1 Visa is a temporary non-immigrant visa and EB-5 is a permanent immigration solution. The EB-5 visa now allows for concurrent filing which can expedite the process to achieving an EAD or employment authorization document. Concurrent filing is when you file the I-526E and the I-485 adjustment of status at the same time. It saves over 12-18 months of processing compared to the original EB-5 policy. The Behring Regional Center has seen new EB-5 investors get their EAD cards in less than 100 days, which is lighting fast compared to other immigration categories. The EAD card allows you to live and work in the United States even before the I-526 is approved. This is why the EAD is so valuable to foreign students, because they are already in the United States with a visa that has lawful status and they are eligible to immediately apply for the I-485. Other visa solutions such as H1-B, E-1 and EB-2 visa’s are temporary non-immigrant visa’s and do not lead to becoming a permanent resident (greencard). F-1 Students also prefer EB-5 investor visa’s because having the greencard can make them more competitive when applying for jobs, give them the freedom to start their own businesses and control their own future. F-1 study abroad visa’s only last for two years and then another solution must be found. EB-5 visa is the fastest and most reliable way to immigrate to the United States.
