EB-5 investors can start an EB-5 investment without $800,000 upfront. EB-5 investors can even file the I-485 petition (EAD card) and start to adjust status without the $800,000 upfront. The requirement is that EB-5 investors need only show that they are in the active process of investing the $800,000. Many investors want to start their EB-5 investment and start their visa process and path to a greencard but they don’t have the full $800,000 required right away. When you can’t invest the entire EB-5 investment amount upfront, there are strategies to spread out the investment over time but typically the full investment amount should be planned to be contributed in 2 years or less. Depending on the project, its need for capital, supply and demand or job creation progress, you may be able to contribute the capital faster or slower.
