
Today’s video is video #4 in a series of 5 videos that talk about some of the most difficult cases for citizenship by investment that we have had and how we were able to have a positive outcome for the client.
One of the very first clients I ever had was under investigation from a financial organization and had a dispute with them. I am not going to provide all that many details about it, however, it was uncertain from the start if the client could be accepted for citizenship. Given that it was in the grey zone the client wanted to try anyway. It turned out that after doing a due diligence background check that this dispute was a problem and given that it appeared to still be ongoing the citizenship unit was not in a position to accept the client at the time. Instead of being denied citizenship we simply decided to withdraw the application and to then re-apply when the dispute was finalized or we had further documentation and evidence to demonstrate that there was no risk for accepting the client. Getting a formal denial for citizenship is problematic as you will need to declare this in any other citizenship application or often residency application. So technically if you have withdrawn you have not been denied.
With time and the case there were a change in circumstances in which the client received a favourable judgment and this allowed the CIU to re-open the client file.
It’s important to disclose to the firm you are dealing with if you are subject to current lawsuits or under investigation. While you can still be accepted with lawsuits against you the CIU may ask further questions. We can do a case evaluation prior to you applying for citizenship.
