So you have an E-1 visa to enter the U.S. What are the tax issues?

The E-1 visa is issued to individuals from a Treaty Country that are engaged in international trade. The E-1 visa allows the individual to live and work from the U.S. for a 2 year period.

As an E-1 visa holder, you will generally meet the substantial presence test to become a U.S. tax resident. U.S. tax residents must file Form 1040, FBARs, and all related forms and schedules required of U.S. tax residents.

It is possible to have an E-1 visa and not meet the substantial presence test, however, you will still likely need to file a Form 1040-NR to report your U.S. source income and pay taxes.
