The L-1 visa is suitable for business owners outside the US who are executives – CEOs or top managers.
To qualify, your company must:
1. Work for at least 1 year at the time of filing the petition. You must also work there for at least 1 year.
2. Your company should employ 10-20+ people.
3. The structure of the company must have 3 levels: you – managers – operational workers.
This visa can be obtained in two ways: by transferring to a US branch of an existing company, or by buying your own business in the US. In both cases, you must prove that the company in the US is related to your company outside of it. If the non-US company ceases to exist, it will not be possible to renew the L-1 visa.
To get a Green Card through an L-1 visa, it can be reclassified into an EB-1C visa. To do this, you need to scale the company up to 10 people and more and increase the net profit to $80 000 – 100 000 a year.
