In order to keep or maintain the right of community residence, in the event of annulment of the marriage, divorce or cancellation of the registration as a registered partner, it is essential that the holder of the residence proves one of the following assumptions:

🔹 Duration of at least 3 years of the marriage or registered partnership status. It must be accredited that, in those 3 years, there has been at least one year of cohabitation in Spain.

🔹 Granting by mutual agreement or judicial decision of the custody of the children of the EU citizen, to the ex-spouse or ex-registered partner who is not a citizen of the European Union.

🔹 Existence of particularly difficult circumstances, such as having been a victim of gender violence or having been subjected by the spouse or registered partner to human trafficking during the marriage or partnership situation.

🔹 Judicial resolution or mutual agreement that determines the visitation rights, to the minor child, of the ex-spouse or ex-partner, when said minor resides in Spain.
