On January 5, 2022, the Department of Homeland Security has dropped its appeal in the case of Behring Regional Center LLC vs Mayorkas.
The November 2019 EB-5 Immigrant Investor Program Final Rule remains vacated and invalid.
The investment amounts have been reduced. The minimum investment amount is, at this moment, 500,000 USD in a project located in targeted employment areas.
All new petitions received since June 2021 will be adjudicated based on the pre-November 2019 EB-5 regulation, and the minimum investment will be 500,000 USD.
All new applications for the EB-5 Program will include and will be adjudicated based on the pre-November 2019 EB-5 Regulations with the lower amount and the targeted employment area certification requirements.
KEEP IN MIND! The EB-5 Regional Center Program has not been reauthorized. Your investment will have to be a direct EB-5 investment.
