
For December 2021 Visa Bulletin, How Department of State Calculate US Visa Assignment in US consulates and US Embassies abroad and within US for Family and Employment category.
The Department of State is responsible for administering the provisions of the I.N.A., Immigration and Nationality Act relating to immigrant visa issuances and publishing visa bulletins like December 2021 visa bulletin for FY2022.
At the beginning of each month, the United States Visa Office receives a report from USCIS., and each consular post abroad, listing totals of documentarily qualified immigrant visa applicants in categories, subject to numerical limitation. Cases are then grouped by foreign state chargeability, preference, and priority date.
All these VISA ASSIGNMENTS are applicable for F1, F2A, F2B, F3, F4, EB1, EB2, EB3, EB4, EB5, IR-1, CR-1, IR-2, IR-3, K1, SE1, H1B, L1A, L1B, L2, H4, TN, H2, F, M, J, E1, E2, B1, B2, Diversity visa, Refugee etc, both for Business Immigration (Work Visa and Investors), Student Visa and Family immigration.
In 2021 as of today there is 2.2 million unused green cards for recapturing, these unused greencards started accumulating since the current green card allotment system took effect in 1992. There are 4 different Greencard recapture Immigration bills and each one takes different approaches for recovering lost greencards benefitting different set of immigrants.
All these 2.2 million unused greencards includes about 561,000 family-based greencards, 582,000 employment greencards, an additional 491,000 employment greencards that were attempted by congress for “recapturing” initially, but went unused again. 151,000 diversity lottery numbers, and 423,000 refugee slots.
This year Biden Administration, Democrats and Republicans in Congress is showing increased interest, to recapture all 2.2 million unused greencards through these 4 different Greencard recapture Immigration bills. some of these bill have passed in the House and some of them have passed in the Senate, some even have a Bipartisan support, awaiting to be signed in to law.
But these different GreenCard Recapture Proposals, Offer unique and Wildly different Outcomes for different set of immigrants.
Immigration Proposal in all these 4 bills would allow U.S. Citizenship and Immigration Services to recapture greencards that would otherwise go to waste, after the agency was unable to grant applications fast enough because of bureaucratic delays, or due to Covid-19 pandemic.
But if none of these works, President Biden may look towards executive orders, he issued more number of executive orders than the former presidents at the beginning of his presidency.
