SPANISH SEPHARDIC CITIZENSHIP 2020 BY REPRESENTATION, TO SIGN IN YOUR NAME IN NOTARY?

As we have explained in other previous videos, the Ministry of Justice published on May 14 a Resolution (Instruction) of April 13, which extends the term FOR ONE MORE YEAR (until September 2021) to complete the files regarding Sephardic Spanish nationality, under Law 12/2015 (files that were opened before October 1, 2019).
Many of you ask us if with COVID, if a lawyer registered in Spain and specialist in Immigration, can represent you in the procedure.
Until now, the 2015 Law did not provide for representation, but I have always thought that Covid was a cause of “force majeure” that is regulated in the Civil Code, and that it should be made more flexible.

How is this issue regulated in the Resolution of April 13? As you will see: it provides that in cases of illness or force majeure, the General Directorate can be requested to exempt from coming to Spain to sign the notary (and we could sign it for you), and it will be valued to grant it case by case .

The General Directorate of Ministry of Justice has advised notaries to be cautious with it, as we have known these days, and we advise prudence here, but by proving the cause or reason well, we can request this exemption and be able to sign with you, although the general rule will continue to be having to come personally to sign, that there is a term of 18 more months at least.
