What is the H2B Visa program for the United States? The H2B visa program allows US employers to fill positions for non-agricultural labor by hiring employees from abroad and on a temporary basis. The H2B visa program is designed to assist the US companies who are encountering difficulties hiring due to shortages of US workers who are willing and able to perform non-agricultural labor.

While the H2B job opportunity can be for skilled labor or unskilled labor or professional labor, the job opportunity is temporary and the H2B program mustn’t be used to fill a permanent position. It is inappropriate to fill a permanent position such as that of a university professor or chair or lecturer.

What is important with the H2B visa program is that the job opportunity is temporary in nature and it’s usually one of the 4 purposes required by the US department of labor which is a One-time occurrence, Seasonal need, Peak-load need, Intermittent need.

In terms of the H2B visas available each fiscal year starting on October 1st there are 66000 H2B visas made available and the US government can increase this number as needed which is often the case. However, certain workers are exempt from the 66000 H2B visa cap and these workers are:
1. a fish roe processor; 2.a fish roe technician; 3. a supervisor of fish roe processing 4. workers who are going to northern Mariana island or Guam.

The H2B visa program is generally used in industries such as the hospitality industry, retail, construction, and warehousing. The most frequently filled position with H2B workers is hotel housekeeping, landscaper laborer, cook, and construction worker.

Generally, the H2B is initially approved for a period of 9 months up to 12 months and can be renewed up to 3 years. After the 3rd year, the H2B visa worker must leave the US and remain outside for 3 months before being able to apply again for an H2B visa.

To keep in mind is that holding other visas such as other H visas or L visa classification counts as time towards the H2B 3-year limit.
